Terms of Service

1. Acceptance of Terms

By accessing or using PakRoozgar ("the Platform"), operated by PakRoozgar Private Limited ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement made between you and the Company, concerning your access to and use of the Platform.

These Terms are governed by the laws of the Islamic Republic of Pakistan, including but not limited to:

• The Contract Act, 1872
• The Electronic Transactions Ordinance, 2002
• The Prevention of Electronic Crimes Act (PECA), 2016
• The Personal Data Protection Bill (when enacted)
• Consumer Protection Act, 2005
• All applicable provincial and federal laws of Pakistan

2. Definitions

• "Platform": Refers to PakRoozgar website, mobile applications, and all related services
• "User": Any individual or entity accessing or using the Platform
• "Customer": Users seeking services from Service Providers
• "Service Provider": Businesses or individuals offering services through the Platform
• "Content": All text, images, videos, reviews, and other materials on the Platform
• "Services": The marketplace platform connecting Customers with Service Providers

3. Eligibility

To use this Platform, you must:

• Be at least 18 years of age or the legal age of majority in your jurisdiction
• Be a resident of Pakistan or legally authorized to conduct business in Pakistan
• Have the legal capacity to enter into binding contracts under Pakistani law
• Not be prohibited from using the Platform under any applicable laws
• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information

For Service Providers, additional requirements include:

• Valid CNIC/NICOP or business registration documents
• Compliance with all applicable business licensing requirements
• Valid NTN (National Tax Number) where applicable
• Compliance with provincial and federal tax obligations

4. Platform Role & Disclaimer

• A party to any transaction between Customers and Service Providers
• An agent, employee, or representative of any Service Provider
• Responsible for the quality, safety, legality, or availability of services
• Liable for any acts, errors, omissions, representations, warranties, breaches, or negligence of any Service Provider
• Responsible for tax obligations arising from transactions
• A guarantor of any services provided through the Platform

All transactions and interactions between Customers and Service Providers are independent contracts to which PakRoozgar is not a party. Any dispute arising from such transactions shall be resolved directly between the concerned parties.

5. User Conduct & Prohibited Activities

Users agree NOT to:

• Violate any laws of Pakistan including PECA 2016 provisions
• Post false, misleading, or fraudulent content
• Engage in harassment, threats, or hate speech against any individual or group
• Share content that violates Islamic values or Pakistani cultural norms
• Impersonate others or misrepresent your affiliation
• Collect or harvest user data without consent
• Post spam, malware, viruses, or harmful code
• Manipulate reviews or ratings
• Engage in money laundering or terrorist financing activities
• Violate intellectual property rights
• Use the Platform for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any portion of the Platform
• Share obscene, defamatory, or blasphemous content as per Pakistani law
• Engage in anti-state activities or spread content against national interest

Violation of these terms may result in immediate account termination and legal action under applicable Pakistani laws.

6. Service Provider Obligations

Service Providers on the Platform agree to:

• Provide accurate and truthful information about their services
• Maintain all required licenses, permits, and registrations
• Comply with all applicable tax laws and file returns as required
• Deliver services as described and agreed with Customers
• Maintain professional standards and ethical business practices
• Respond to customer inquiries in a timely manner
• Honor quoted prices and service commitments
• Maintain adequate insurance where required by law
• Not engage in unfair competition or deceptive practices
• Protect customer data and privacy
• Comply with consumer protection laws

7. Intellectual Property Rights

Platform Ownership: All rights, title, and interest in the Platform, including all software, design, text, images, and trademarks, are owned by PakRoozgar or its licensors and are protected under Pakistani and international intellectual property laws.

User Content License: By posting content on the Platform, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, modify, publicly perform, publicly display, reproduce, and distribute such content for Platform operations and marketing.

Copyright Infringement: We respect intellectual property rights. If you believe any content violates your copyright, please contact us with:

• Description of the copyrighted work
• URL of the infringing content
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury

8. Payments & Fees

Transaction Fees: PakRoozgar may charge service fees for certain features or transactions. All fees will be clearly disclosed before you incur them.

Payment Processing: We use third-party payment processors. By using payment services, you agree to their terms and conditions.

Taxes: Users are responsible for all applicable taxes including:

• Federal and provincial sales tax
• Income tax on earnings
• Withholding tax where applicable
• Any other taxes as per Pakistani tax laws

Refund Policy: Refunds are processed according to our Refund Policy. Subscription fees are generally non-refundable except as required by law.

9. Limitation of Liability

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Damages arising from your use or inability to use the Platform
• Any conduct or content of any third party on the Platform
• Unauthorized access, use, or alteration of your content
• Claims exceeding PKR 10,000 in aggregate

These limitations apply regardless of the theory of liability, whether based on warranty, contract, tort (including negligence), or any other legal theory.

10. Indemnification

You agree to defend, indemnify, and hold harmless PakRoozgar, its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses arising from:

• Your violation of these Terms
• Your violation of any third party rights
• Your violation of any applicable law
• Your content or information provided to the Platform
• Your use of services obtained through the Platform
• Any dispute between you and other users

11. Dispute Resolution

Governing Law: These Terms are governed by the laws of Pakistan without regard to conflict of law principles.

Arbitration: Any dispute arising from these Terms shall first be attempted to be resolved through good faith negotiations. If negotiations fail, disputes shall be resolved through arbitration under the Arbitration Act, 1940 of Pakistan.

Jurisdiction: The courts of Karachi, Pakistan shall have exclusive jurisdiction over any disputes that cannot be resolved through arbitration.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with Pakistani data protection laws and international standards.

By using the Platform, you consent to:

• Collection and processing of your personal data as described in our Privacy Policy
• Transfer of data to servers located in Pakistan or abroad
• Sharing of necessary information with Service Providers for service delivery
• Use of cookies and similar technologies

13. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for any reason including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Creating multiple accounts
• Extended periods of inactivity
• Request by law enforcement or court order

Upon termination, your right to use the Platform ceases immediately. We may retain certain information as required by law or for legitimate business purposes.

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or Platform notification. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.

If you disagree with any changes, you must discontinue use of the Platform and terminate your account.

15. General Provisions

Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms constitute the entire agreement between you and PakRoozgar regarding the Platform and supersede all prior agreements.

Waiver: No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.

Assignment: You may not assign or transfer these Terms or your rights under these Terms without our prior written consent.

Force Majeure: We shall not be liable for any delay or failure due to causes beyond our reasonable control including acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

17. Acknowledgment

BY USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE NOT AUTHORIZED TO USE THE PLATFORM.
